Breach of confidence cases involve the disclosure or misuse of information which is confidential by nature and which has been, or is threatened to be, disclosed without permission. The confidential information can relate to an individual, but cases of this kind frequently concern business secrets or other commercially sensitive information which has fallen into the wrong hands. Sometimes this will also involve a breach of covenant by a departing colleague or employee.
We have considerable experience of acting in breach of confidence cases, which often involve urgent action including an application for an injunction. In extreme cases we may be able to obtain a search order without prior notice to the defendant.
